These Terms of Service govern your use of daisyslist.com and the services offered on it (the "Service"), operated by Daisy's List ("Daisy's List", "we", "us"). By using the Service you agree to these terms. If you do not agree to them, do not use the Service.
1. Who may use the Service
You may browse the directory without an account. To create an account you must be at least 18 years old and able to enter into a binding contract. You agree to give accurate information when you register, to keep it current, and to keep your password confidential. You are responsible for everything that happens under your account. Tell us through our contact form if you believe your account has been used without your permission.
2. What the Service is
Daisy's List is an informational directory of childcare providers. We compile listings from state licensing records and other publicly available sources, organize them, and make them searchable. We also let a provider claim its own listing and add information to it.
3. What the Service is not
We are not a childcare provider, a licensing authority, a referral agency, or a party to any arrangement you make with a provider. We do not inspect, vet, screen, endorse, recommend, or guarantee any provider listed on the Service, and a listing's presence on the site is not a recommendation of it.
Listing information may be incomplete, out of date, or wrong. It comes from third-party records that change without notice and that contain errors we cannot see. Licensing status, capacity, ages served, hours, inspection history, pricing and contact details can all change between the time a record is published and the time you read it.
You must verify anything that matters to you directly with the provider and with your state's licensing authority before making a decision about the care of a child. Choosing childcare is a decision you make on your own judgment. Do not rely on this Service as your only source, and do not treat it as professional, legal or safety advice.
Any dealings between you and a provider, including visits, enrollment, contracts and payments, are solely between the two of you. We are not responsible for them and we have no obligation to become involved in a dispute about them.
4. Claiming and managing a listing
By claiming a listing you represent that:
- You are the owner or operator of that provider, or are authorized to act for it.
- The information you submit is accurate, is not misleading, and is kept up to date.
- You own or have permission to use every photograph and description you upload, and that none of it infringes anyone's rights.
We verify claims using the contact details already published on the listing. We may approve, refuse or revoke a claim at our discretion, and we may remove content or revoke a claim we believe was made without authority or that contains false information. Claiming a listing does not give you ownership of the listing or of the directory record behind it.
You keep ownership of the content you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for display, and publish that content on the Service and in materials promoting it, for as long as your content remains on the Service.
5. Fees
The Service is currently provided free of charge. We do not take payment for access to the directory, and we do not ask you for card details.
We may introduce paid features in the future. If we do, we will show you what is included and what it costs before you commit to anything, and you will never be charged without agreeing to the price and the terms that apply at that time. Nothing in these terms obliges us to keep any part of the Service free, and the features available without charge may change.
6. Acceptable use
You agree not to:
- Scrape, crawl, harvest, or otherwise extract listings or data in bulk, whether manually or by automated means, without our prior written permission.
- Copy, resell, republish, license, or redistribute the directory or any substantial part of it, or use it to build a competing product or dataset.
- Access the Service through automated means, or in a way that places an unreasonable load on our systems or interferes with anyone else's use of them.
- Attempt to gain unauthorized access to any part of the Service, another user's account, or our systems, or work around any security or access restriction.
- Submit false, misleading, unlawful, defamatory, harassing, or infringing content, or claim a listing you are not authorized to claim.
- Use contact details obtained from the Service to send unsolicited commercial messages.
- Use the Service for any unlawful purpose or in violation of these terms.
We may investigate suspected violations and may suspend or terminate access to anyone who breaches this section.
7. Our intellectual property
The Service, including its design, software, text, graphics and the selection, arrangement and compilation of the directory, is owned by Daisy's List and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Nothing in these terms transfers any of our rights to you.
8. Third-party links and services
The Service links to provider websites, licensing records and other outside pages, and relies on third-party services for hosting, maps, email, analytics and advertising. We do not control those sites and services, we are not responsible for their content, availability or practices, and a link is not an endorsement. Your use of them is governed by their terms, not ours.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that defects will be corrected, or that any information on the Service, including any listing, is accurate, complete or current.
10. Limitation of liability
To the fullest extent permitted by law, Daisy's List and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service or your reliance on any listing, whether based in contract, tort, negligence, strict liability or any other theory, and whether or not we have been advised of the possibility of those damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the two sections above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
11. Indemnification
You agree to indemnify and hold harmless Daisy's List and its owners, employees and agents from any claim, demand, loss, liability or expense, including reasonable attorneys' fees, arising out of your use of the Service, any content you submit, your breach of these terms, or your violation of any law or of anyone else's rights.
12. Suspension and termination
You may stop using the Service at any time and may delete your account from your account settings. We may suspend or terminate your access, with or without notice, if you breach these terms, if we are required to by law, or if we discontinue the Service. Sections that by their nature should survive termination, including sections 3, 7, 9, 10, 11 and 13, will survive it.
13. Governing law and disputes
These terms are governed by the laws of the United States and of the state in which Daisy's List is established, without regard to conflict of law rules. You agree that any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in that state, and you consent to the jurisdiction of those courts. If any provision of these terms is found unenforceable, the rest remains in force.
14. Privacy
Our Privacy Policy explains what information we collect and how we handle it. It forms part of these terms.
15. Changes to these terms
We may update these terms as the Service changes. When we do, we will revise the "last updated" date at the top of this page. If a change is material, we will give you notice by email at the address on your account, or by a prominent notice on the site, before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated terms.
